THE RULES FOR CARRIAGE OF PASSENGERS AND BAGGAGE ON BUSES AND TROLLEYBUSES IN VILNIUS CITY MUNICIPALITY

 

SECTION I

GENERAL PROVISIONS

 

1. The Rules for Carriage of Passengers and Baggage on Buses and Trolleybuses in Vilnius city municipality (hereinafter – the Rules) are prepared in accordance with Road Transport Code of the Republic of Lithuania, The Rules for Carriage of Passengers and Baggage by Road transport, approved by order No 3-223 of the minister of communication of the Republic of Lithuania "On the approval of the Rules for Carriage of Passengers and Baggage by Road transport" of 13 April 2011, and other legislation, regulating the carriage of passengers and baggage.

2.  The Rules determine the procedure of carriage by buses and trolleybuses in Vilnius city municipality, duties and responsibilities of the carrier, driver and passengers, rights of passengers, as well as terms of control of carriers, drivers and passengers.

3. The carriage of passengers and baggage by buses/trolleybuses is organised by Vilnius City Municipality (hereinafter – the Municipality) or its authorised institution.

4.  Definitions that are used in these rules:

4.1.  ticket – paper or electronic document of a specified form, giving the right to ride on a public transportation of Vilnius city municipality; 

4.2.  traffic timetable – rules, defining time of arrival and departure of vehicle to and from the initial, final, and intermediary stops of the route;

4.3. electronic ticket – electronic limited ticket with the duration of 1 day or longer, dedicated for one passenger to ride the public transportation during the specified period;

4.4.  authorised institution – Municipality enterprise authorised by the Vilnius city municipality, which plans routes, compiles timetables, issues permits for the carrier to transport passengers over the route, ensures the production and distribution of tickets, performs passenger and traffic control in the vehicles of the carrier, and other functions specified in the legislation;

4.5. passenger control – inspection of passenger tickets performed by the authorised institution or the carrier;

4.6. commencement of passenger control – the moment, when a bus/trolleybus drives up to the entrance of the stop, which is being approached and where controllers perform passenger control, and the driver blocks ticket marking machines;

4.7. end of passenger control – the moment, when controller exits the vehicle, marks end of control in the special inspection tools, and the driver unblocks the ticket marking machines;

4.8. route – route of a street or a road, over which passengers are transported by vehicle with a set frequency, accepting/discharging passengers during the trip only at stops specified for that purpose, according to the traffic timetables set in advance;

4.9. stop – location, intended for passengers to wait for a vehicle, as well as to safely board/exit it;

4.10. "stop on demand" – a stop for the awaiting of public transport, not included in the timetables of the public transportation, where the driver does not have to stop if there are no boarding or exiting passengers;

4.11. vehicles buses and trolleybuses, intended to transport passengers along the routes the mandatory service of which is approved by the order of the director on Municipality administration;

4.12. single use ticket – a paper ticket purchased from the driver or an electronic 30 minutes or 60 minutes ticket, intended for a single public transport ride of one passenger (with or without connection).

5.  Other definitions used in the rules are understood in the same way as they are defined in the Road Transport Code, and other normative legislation that regulates carriage over the local (municipal) regular communication routes.

 

SECTION II

ORGANISATION OF THE TRAFFIC OF THE PUBLIC TRANSPORTATION

 

6. Local regular traffic of public transportation is organised over the roads and streets, condition of which meets the Requirements for streets and roads, where the traffic of a regular passenger transport takes place, approved by the order No. 3-747 of the minister of communication of the Republic of Lithuania "On the approval of Requirements for streets and roads, where the traffic of a regular passenger transport takes place" of 29 November 2011.

7. During regular routes, public transportation must arrive at the stops on the specified time set in the timetables.

8. Routes of the local regular public transportation are initiated, adjusted, or terminated at the initiative of the Municipality or the authorised institution in accordance with the terms of legislation.

9. The carrier has the right to temporarily suspend the regular traffic of vehicles, if there are impassable roads, extreme weather conditions, or natural disasters, after notifying of that Municipality and the authorised institution.

10. Municipality and the authorised institution organises the traffic of the public transportation in such a manner that it would be granted traffic superiority, i.e. by creating a lanes dedicated only to the public transport ("A" lanes) and by granting the superiority rights in the regulated intersections. 

11. Municipality and the authorised institution ensures proper and safe infrastructure for the transportation of passengers: maintenance of streets and intersections, lighting, construction of stops, as well as performs all other actions that are necessary to maintain proper condition of the infrastructure. They also ensure the effective control that the infrastructure was used as intended (e.g., blockage of entrances of stops, traffic circles, etc. with vehicles).

SECTION III

STOPS

 

12. Stops are build according to the road technical regulation KRT 1.01:2008 "Automobile roads" and regulation of the construction technical requirements STR 2.06.04:2014 "Streets and roads of the local significance. General requirements". Road signs "Bus stop" are placed according to the requirements of the Traffic rules, Rules for road sign installation and vertical marking, and the description for the procedure of the installation and maintenance of technical traffic regulation measures in Vilnius city.

13. Locations of stops in the local (municipal) regular communication routes are specified, and the information at the public transportation stops is published and updated by the authorised institution after coordinating it with the Municipality.

14. Based on passenger flows and need, "stops in demand" can be built. They are built according to the procedure that is specified in the paragraph 25 of the rules.

 

SECTION IV

CARRIER'S AND DRIVER'S DUTIES AND RESPONSIBILITY

 

15.  The carrier must:

15.1.  ensure the compliance with the established routes and traffic timetables;

15.2.  ensure safe carriage of passengers and baggage;

15.3.  ensure cleanliness of vehicles;

15.4. display these rules, as well as extracts from the legislation of the Republic of Lithuania, regulating transport privileges, on vehicles in prominent places;

15.5. specify vehicle's garage number, as well as phone numbers of the carrier and control services that control the carriers and passengers or their authorised legal persons.

15.6.  ensure the presentation of information about the "stops on demand" that are upcoming in the route, in vehicles that are providing passenger transportation services in routes, where the "stops on demand" are built.

16.   The driver has the right to:

16.1. discharge the passengers without a ticket or who refuse to buy a ticket;

16.2. refuse to accept on board or discharge at the closest stop of any type passengers, who are under the influence of psychoactive substances (drugs, medication, or other intoxicating substances), wear dirty clothes or carry baggage that is prohibited to transport;

16.3. politely and respectfully ask passengers to conduct themselves in a vehicle properly, i.e. do not make noise, do not consume alcohol drinks, do not litter (in case of littering, to collect their trash and take it away), do not stain or damage surfaces of a vehicle in another way, and to observe other obligations specified in these rules and other legislation;

16.4.  exercise control on behalf of the carrier.

16.5.  call the police for passengers who violated provisions of paragraphs 16.1, 16.2, and 16.3, and refused to exit the vehicle.

17.   The driver must:

17.1. be thoughtful, attentive and helpful, announce the names of the stops, and if a passenger asks, inform about the terms of payment and route of the;

17.2. pay special attention to passengers with disability, help them to board/exit the vehicle;

17.3. comply with the schedule, the established routes and traffic timetables, as well as to inform passengers about the changed route;

17.4. block electronic ticket machines before driving into the entrance of the stop, where the passenger control will be performed, and immediately inform the passengers that passenger control will be performed at the nearest stop;

17.5. at the request of controller, provide the following trip documents: the trip sheet, a copy of the licence or a copy of the Community licence, permit to carry passengers on regular routes, traffic timetable approved by the Municipality, and other statutory documents.

17.6. at the stops that specify boarding through the front door, stop according to the markings, take the passengers only through the front door, and discharge only after making sure that all passengers, who want to go have already boarded;

17.7.  always turn of the engine of a vehicle at the final stop of the route;

17.8.  sell tickets to passengers only after a vehicle has stopped at the stop;

17.9. ensure the proper amount of low value coins and tickets of all values;

17.10. ensure the safety of items left behind by passengers, if such were found in the vehicle.

18.  Carrier must ensure that during working hours driver would wear a neat and clean working uniform.

19. Drivers are not allowed to smoke and to play loud music on board of a vehicle. At the request of passenger, the driver must reduce the volume or turn off the radio or audio player.

20. Driver stops the vehicle in the stop according to the specified marking, and no further than 15 cm from the edge of the sidewalk, and where there is no sidewlak, stops by the edge of the road according to the requirements of the Traffic rules. Doors for boarding/exiting are opened only after a vehicle has stopped completely.

21. The carrier and the driver shall be liable for the breach of these rules according to the terms set in the legislation of the Republic of Lithuania.

SECTION V

RIGHTS, DUTIES AND RESPONSIBILITY OF PASSENGERS

 

22. Passengers are waiting for vehicles at stops, as far as possible from the edge of the sidewalk, and may board it only after it stops completely. Vehicle that started to drive away from the stop does not accept passengers.

23. The passengers shall enter and exit a vehicle according to the information signs placed by the carrier on the door. It is forbidden to enter / exit the vehicle after an audio signal has sounded.

24. Passengers get ready to exit in advance, before the vehicle arrives at the stop, i.e. come closer to the exit door (all, except the first one). If needed vehicle can be boarded through the front doors by disabled persons, passengers with small children, pregnant women and elderly passengers. If the vehicle i full, the passengers are discharged at the stops through the front doors.

25.  A passenger, who wants to exit at the "stop on demand" must press the button "STOP", and if such button is absent, must notify the driver in advance while the vehicle of the public transportation is standing at the stop, which is before the "stop on demand". A driver must stop at the "stop on demand" and take passengers, who are waiting for public transport, and standing by the road sign "Bus stop".

26. Disabled persons, passengers with small children, pregnant women and elderly passengers have a priority to board the vehicle. The other passengers must relinquish the seats that are marked with inscriptions "For passengers with children" and "For the disabled persons" or other respective symbols.

27. People with disabilities in wheelchairs, as well as small children in strollers must be transported, except the cases, when a wheelchair or a stroller does not fit into the cabin of a vehicle. No fee is charged for a wheelchair and a stroller.

28.  A passenger has the right to make a comment towards passengers who are behaving improperly, and inform the driver about the damage of a vehicle that was noticed and persons, who are damaging the vehicle and its equipment. 

29.  Passengers must: 

29.1. immediately mark/activate the available ticket after boarding a vehicle;

29.2.  board a vehicle through the front door if they do not have a ticket, purchase a ticket from the driver, and immediately mark it/activate it;

29.3. ensure in advance as precise amount of money as possible for the purchase of a ticket, when they are buying a single use ticket from the driver;

29.4. follow the rules, information signs that are displayed on vehicles, as well as requirements that are announced by audio signals;

29.5. possess the properly marked/activated ticket until the end of the trip, prepare it for inspection immediately after the announcement that the passenger control will be performed, and produce it to a driver or persons, performing a passenger control;

29.6. possess a valid document, entitling to use a ticket with a transport privilege, if a ticket was bought with a discount;

29.7. take care of own safety and that of transported items, sit down if there are available places, when standing hold on to the handrails that are installed in the vehicle, do not lean against the doors of the moving vehicle, and do not leave personal belongings when exiting;

29.8. exit at the final stop of the route;

29.9. perform lawful demands of controllers and the vehicle driver;

29.10. give to the driver the item that they found on a vehicle and that does not belong to them.

30. The passengers are forbidden from:

30.1. buying and marking/activating two or more tickets with a discount, specified in the Law on Transport Privileges of the Republic of Lithuania, instead of one ticket;

30.2. open the door of the driver’s cabin or talk to the driver or to disturb him/her in any other way while a vehicle is moving;

30.3. riding while under the influence of psychoactive substances (drugs, medications or other intoxicating substances), emitting rancid smell, wearing dirty clothes, staining or damaging the exterior and interior of the vehicle, keeping the feet on seats, letting children stand on the seats or place baggage on them, making noise, playing the music loud, or disturb public order in other way;

30.4. smoking, eating, drinking, littering, making noise, or violating public order in other ways, and disturbing other passengers.

31.  If the vehicle broke down, the marked/activated ticket entitles the passenger to ride on another vehicle until the final stop of the route or according to conditions specified in the ticket.

32.  A perpetrator must compensate the damage that was caused to the Carrier (damaged exterior or interior of a bus/trolleybus, broken or scratched glass, etc.) in accordance with the procedure specified by the laws.

 

SECTION VI

TICKETS AND THEIR MARKING

 

33.  Tickets are made of paper, or recorded and stored in a digital database (electronic tickets), or purchased by using “m. Ticket” mobile application or other mobile applications that are adapted for smart mobile devices.

34.  A single use paper ticket shall be marked using electromechanical or mechanical ticket marking machine.

35.  An electronic ticket shall be activated using ticket marking machine or another device. An electronic ticket that is recorded and stored in a digital database, shall be activated by putting a card next to an electronic ticket marking machine on board of a vehicle, or by using other devices that are designed to activate an electronic ticket. An electronic ticket shall be valid for the period of time that is indicated in the ticket. During the period of its validity, an electronic ticket shall not be activated for the second time.

36.  After a passenger boards the vehicle and if he/she does not have a valid activated ticket, he/she must immediately buy/activate a ticket at the same stop, by using one of the following methods:

36.1. by activating an electronic ticket;

36.2. by purchasing a ticket from e-wallet;

36.3. by purchasing a single use ticket from a driver;

36.4.  by activating a ticket using “m. Ticket” or other mobile applications.

37.  Tickets activated in the mobile applications become valid after the activation period, specified in their terms of use, has passed.

38.  A marked single use paper ticket that was purchased from a driver entitles to ride on a single vehicle along the one route until final stop of that route. An electronic ticket entitles to ride on vehicle according to conditions specified therein.

39.  A passenger, who intends to buy a ticket or, who is unable to present a valid document, entitling him/her to transport privileges, during passenger control, shall buy a ticket at full price.

40.  Passengers are entitled to privileges according to the terms specified in the Law on Transport Privileges of the Republic of Lithuania.

41.  A ticket shall be considered invalid if during the inspection it cannot be decrypted (decoded) from an electronic ticket media, its number is illegible or a mark made by a ticket marking machine on a single use ticket or a ticket bought from a driver cannot be recognised;

42. A passenger can return unused (not activated) tickets within 14 calendar days from the purchase of tickets according to the terms set and published by the legislation and Municipal Enterprise “Susisiekimo paslaugos”. Money for the tickets shall be refunded no later than within 14 calendar days from the date on which the request and purchase document were submitted and the ticket was surrendered. Money for the tickets that were purchased from a driver shall be refunded by a carrier according to the approved and published terms.

SECTION VII

CARRIAGE OF BAGGAGE

 

43.  A passenger has the right to carry one unit of a hand baggage free of charge, the dimensions of which do not exceed 60x40x20 cm or the total of the dimensions of which does not exceed 120 cm. The restriction of dimensions shall not be applied to winter sports items and one hand baggage unit carried by schoolchildren or students, which is necessary for their education or studies.

44.  A passenger, who marked an additional single use (full price) ticket, purchased from a driver, can carry:

44.1. a second unit of a hand baggage free of charge, the dimensions of which do not exceed 60x40x20 cm or the total of the dimensions of which does not exceed 120 cm.

44.2. a hand baggage unit, the dimensions of which exceed 60x40x20cm or the total of the dimensions of which exceed 120 cm; however, it cannot hinder passengers, be bulky, stain the seats of bus/trolleybus or passenger clothing.

45. The passenger himself/herself is responsible for the safety of the baggage that he/she is transporting.

46. It is forbidden to transport in vehicles flammable, explosive, smelly, radioactive substances, compressed and liquefied gases (excluding gases in portable containers), as well as sharp, pointed, bulky items that would disturb passengers, firearms without observing the requirements of firearm transportation, and items that could stain the seats of a vehicle or passenger clothing. It is also forbidden to transport bicycles by vehicles, unless the vehicle has an area that is specially designated for that.

SECTION VIII

TRANSPORTATION OF PETS

 

47. A passenger is entitled to carry a pet in a container free of charge.

48. A container with a pet shall allow passengers to pass by, it cannot be bulky, or stain the seats of a vehicle or passenger clothing.

49. A passenger, having documents specifying vaccinations of his/her pet, is entitled to transport a pet on a vehicle without a container free of charge. A dog must wear a muzzle (except for dogs of decorative species), be kept on a leash that is no longer than 0.5 m, and it must not occupy a seat.

50. If a pet stained a cabin of a vehicle, a passenger, who is transporting it shall immediately clean up the stained spot of a cabin.

51. A passenger is responsible for damage caused to health, life, property, and peace of mind of other passengers, and must compensate it. A passenger must also comply with Rules on pet and animal keeping in the territory of Vilnius City, approved by the Council of Vilnius City Municipality.

 

SECTION IX

PASSENGER CONTROL

 

52. A passenger control can be performed by control services of municipal institutions or their authorised offices, employees of a carrier or its authorised legal entity (hereinafter – the controller), as well as state institutions to whom such right is granted by the law.

53. A controller must wear an identification badge (identity card or a pin) or a uniform and show controller’s licence at the request of a passenger.

54. Controller checks an electronic ticket by using special inspection tools.

55.  At the request of controller, the passenger must present a properly marked/activated ticket.

56.  If a passenger provides a marked/activated ticket with a discount, he/she must also provide a valid document, entitling to use a ticket with a transport privilege.

57. A passenger is deemed riding without a ticket or transporting a child from school age to fourteen years old without a ticket, as well as a child from fourteen to sixteen years old is deemed as riding without a ticket, if during the passenger control, he/she has not provided any ticket; provided a valid (activated) ticket with a discount; unable to present a valid document, entitling to use a ticket with a transport privilege; presented an unmarked single use paper ticket purchased from a driver; a single use paper ticket purchased from a driver that has been marked twice or more; a single use paper ticket purchased from a driver that has been marked on another vehicle; presented a ticket that was marked/activated during the inspection; or presented an invalid (not activated) ticket.

58. A passenger, who purchased a ticket with discount, but is unable to present the necessary documents, entitling to use a ticket with a transport privilege, riding on board without a ticket, transporting a child from school age to fourteen years old without a ticket, a child from fourteen to sixteen years old riding without a ticket or a passenger, who has not paid for the baggage or carries forbidden baggage, shall be subject to administrative liability pursuant to the procedure specified by the law. Controller has the right to discharge the passengers from the vehicle.

59. If a controller establishes a violation of these rules, he/she shall drafts a protocol of administrative violations to a passenger and, under appropriate conditions, he/she shall also write an administrative order or issues a decision. A case of administrative violation shall be examined according to the procedure laid down in the Code of Administrative Violations of the Republic of Lithuania.

60. If controller establishes a violation of these rules, a passenger at the request of a controller must present his/her identity document.

61.  Controller has the right to:

61.1. discharge a passenger, who rode without a ticket, from the vehicle and demand to present an identity document in order to draft a protocol of administrative violation;

61.2. call the police and transfer offender to police officers, if a passenger, who rode without a ticket, fails to comply with lawful orders of controller and/or tries to leave from the place where violation was committed;

61.3. bring the passengers, who are no younger than 16 years of age, to the police station if they rode without tickets, had no or refused to present their identity documents, required to draft a protocol of administrative violation; 

61.4. confiscate invalid or counterfeit tickets and documents;

61.5. demand that passengers perform his/her lawful orders;

61.6. enter a bus/trolleybus out of turn, regardless of the number of passengers on board.

62.  Imposition of an administrative penalty does not release a passenger from the obligation to pay for further ride and/or carriage of baggage.
