THE RULES FOR CARRIAGE OF PASSENGERS AND BAGGAGE ON BUSES AND TROLLEYBUSES IN VILNIUS

 

I.            GENERAL PROVISIONS

 

1.             The Rules for Carriage of Passengers and Baggage on Buses and Trolleybuses in Vilnius (hereinafter the Rules) are prepared in accordance with Road Transport Code of the Republic of Lithuania, The Rules for Carriage of Passengers and Baggage by Road, approved by order No 3-223 of 13 April 2011, and other legislation, regulating the carriage of passengers and baggage.

2.             The Rules determine the procedure of carriage by buses and trolleybuses (hereinafter buses/trolleybuses) in Vilnius, duties and responsibilities of the carrier, driver and passengers, rights of passengers and their control.

3.             The carriage of passengers and baggage by buses/trolleybuses are organised by Vilnius City Municipality (hereinafter the Municipality) or its authorised institution.

 

II.           DUTIES AND RESPONSIBILITY OF THE CARRIER AND DRIVER

 

4.             The carrier shall:

4.1         Ensure the compliance with the established routes and traffic timetables;

4.2         Ensure safe carriage of passengers and baggage;

4.3         Ensure cleanliness on buses/trolleybuses;

4.4         Display these rules on buses/trolleybuses, as well as extracts from the legislation of the Republic of Lithuania, regulating transport privileges;

4.5         Specify bus/trolleybus number, as well as phone numbers of the carrier and Passenger Control, regulating the carriers and passengers or their authorised legal persons.

5.             The driver shall have the right to:

5.1         Set down the passengers who refuse to pay the fare (to buy a ticket);

5.2         Refuse to load or set down at the closest stop of any type passengers who are under the influence of alcohol, intoxicated with psychoactive substances (drugs, medicines or other intoxicating substances), wear dirty clothes or carry luggage that is forbidden to transport;

5.3         Exercise control on behalf of the carrier.

6.             The driver shall:

6.1         Be thoughtful, attentive and helpful, announce the names of the stops, and if a passenger asks, inform him/her about the procedure of payment for travel;

6.2         Comply with the schedule, the established routes and traffic timetables, as well as to inform passengers about the changed route;

6.3         Block electronic ticket machines before approaching an entrance of the stop and immediately inform the passengers that passenger control will be performed at the nearest stop;

6.4         At the request of controller, provide the following travel documents: the journey form, a copy of the licence or a copy of the Community licence, permission to carry passengers on regular routes, traffic timetable that is approved by the Municipality and other statutory documents.

7.             Drivers clothing shall be neat and clean. Drivers are not allowed to smoke and to play loud music on board. At the request of passenger, the driver shall reduce volume or turn off the radio or audio player.

8.             The driver shall sell tickets only at the bus/trolleybus stop.

9.             A bus/trolleybus shall be stopped according to the specified marking.

10.         The carrier and the driver shall be liable for the breach of these rules according to the procedure laid down by the legislation of the Republic of Lithuania.

 

III.        RIGHTS, DUTIES AND RESPONSIBILITY OF PASSENGERS

 

11.         The passengers shall wait for a bus/trolleybus at the bus/trolleybus stops and enter or exit the bus/trolleybus only after it stops at the stop.

12.         The passengers shall enter and exit a bus/trolleybus according to the information signs that the carrier has placed on the door. It is forbidden to enter or exit the vehicle after an audio signal.

13.         Disabled persons, passengers with small children, pregnant women and elderly passengers shall have a priority to enter the bus or trolleybus, but only after the controllers. The other passengers shall leave the seats that are marked with signs "For passengers with children" and "For the disabled persons" or another respective symbol for the indicated persons.

14.         The passenger shall have the right to carry two children, who are 7 years old or younger, free of charge, if they do not occupy a separate seat, as well as to be entitled to privileges that are established by the Law on Transport Privileges of the Republic of Lithuania.

15.         People with disabilities shall be carried in the wheelchairs; meanwhile, small children shall be carried in the strollers on board, except the cases, when a wheelchair or a stroller does not fit into the cabin of a bus/trolleybus. A wheelchair and a stroller shall not be taxed.

16.         The passenger shall:

16.1     Buy a ticket and mark/activate it;

16.2     Follow the rules, information signs that are displayed on a bus/trolleybus, as well as other requirements that are announced by audio signals;

16.3     Possess the properly marked/activated ticket until the end of the trip, prepare it for inspection immediately after the announcement that the passenger control will be performed, and produce it to a driver or persons, performing a passenger control;

16.4     Possess a valid document, entitling to use a ticket with a transport privilege if a ticket was bought with a discount;

16.5     Take care of his/her safety, sit down if there are available places, hold on to the handrails that are installed on the bus/trolleybus;

16.6     Exit at the final stop of the route;

16.7     Comply with legal requirements of controllers.

17.         The passengers are not allowed:

17.1     To buy and mark/activate two or more tickets with a discount, provided in the Law on Transport Privileges of the Republic of Lithuania, instead of one ticket;

17.2     To open the door of the driver’s cabin and talk to the driver or to disturb hum/her in any other way during the time of driving the bus/trolleybus;

17.3     To ride under the influence of alcohol, intoxicated with psychoactive substances (drugs, medicines or other intoxicating substances), spreading strong smell, wearing dirty clothes, stain or damage the exterior and interior of the bus/trolleybus, let children stand on the seats or place baggage on them;

17.4     To smoke, eat, drink, litter, make noise or violate public order in other ways and to disturb other passengers.

18.         If the bus/trolleybus broke down, the marked/activated ticket entitles the passenger to ride on another bus/trolleybus until the final stop of the route or according to conditions specified in the ticket.

19.         A perpetrator shall indemnify for the damage caused to the Carrier (damaged exterior or interior of a bus/trolleybus, shattered or scratched glass of window and etc.) in accordance with the procedure laid down in the laws.

 

IV.        TICKETS AND THEIR MARKING

 

20.         There are single (bought from a driver), short-term (valid up to 24 hours) or long-term (valid for 24 hours and longer) tickets. They can be made of paper, recorded and stored in a digital database (electronic tickets), or purchased using m. Ticketmobile application that is adapted for smart mobile devices. A single paper ticket shall be marked using electromechanical or mechanical ticket machine. An electronic ticket shall be activated using ticket machine or other device. An electronic ticket that is recorded and stored in a digital database, shall be activated by touching a card to an electronic ticket machine on board, or using other devices that are designed to activate an electronic ticket. An electronic ticket shall be valid for the period of time that is indicated in the ticket. During its validation period, an electronic ticket shall not be activated for the second time.

21.         A passenger, who entered the bus/trolleybus and does not have a valid activated ticket, shall immediately buy/activate a ticket at the same stop, using one of the following methods:

21.1     To activate an electronic ticket;

21.2     To purchase ticket using electronic money (e-wallet);

21.3     To purchase a single ticket from a driver;

21.4     To activate a ticket using m. Ticketmobile application.

22.         A passenger shall immediately mark a single ticket that was purchased from a driver at the same stop.

23.         A marked single ticket that was purchased from a driver entitles to ride by one bus/trolleybus in the direction of the route until final stop of that route. An electronic ticket entitles to ride on buses and/or trolleybuses according to conditions specified therein.

24.         A passenger, who does not have a valid document, entitling him/her to transport privileges, shall buy a ticket for a full price.

25.         The passengers shall be entitled to privileges according to the procedure laid down by the Law on Transport Privileges of the Republic of Lithuania.

26.         A ticket shall be considered invalid if during the inspection it cannot be decrypted (decoded) from an electronic ticket media, its number is illegible or a mark on a single ticket made by a ticket machine cannot be recognised;

261. A passenger can return unused (not activated) tickets within 14 calendar days from the purchase of tickets according to the procedure laid down by the legislation and Municipal Enterprise Susisiekimo paslaugos. Money for the tickets shall be refunded no later than within 14 calendar days from the provision of request, purchase document and the date of ticket provision/refusal. Money for the tickets that were purchased from a driver shall be refunded by a carrier according to the approved and publicly available procedure.

 

V.         CARRIAGE OF BAGGAGE

 

27.         A passenger has the right to carry one hand baggage free of charge, which dimensions do not exceed 60 x 40 x 20 cm or which total amount of dimensions does not exceed 120 cm. The restriction of dimensions shall not be applied to winter sports items and one hand baggage unit carried by schoolchildren or students, which is necessary for their education or studies.

28.         A passenger, who marked an additional single (full price) ticket, purchased from a driver, can carry:

28.1     A second hand baggage, which dimensions do not exceed 60 x 40 x 20 cm or which total amount of dimensions does not exceed 120 cm;

28.2     A hand baggage, which dimensions exceed 60 x 40 x 20 cm or which total amount of dimensions exceed 120 cm; however, it cannot obstruct passengers, be bulky, stain the seats of bus/trolleybus or passengers’ clothing.

29.         The passenger shall be responsible for safety of his/her luggage.

30.         It is forbidden to carry flammable, explosive, smelly, radioactive substances, compressed and liquefied gases (excluding gases in portable containers), as well as sharp, acute, bulky items in buses/trolleybuses that would disturb passengers, unwrapped or caseless firearms and items that could stain the seats of bus/trolleybus or passengers’ clothing. It is also forbidden to carry bicycles in buses/trolleybuses, unless there is a specially designated area on bus/trolleybus.

 

VI.      TRANSPORTATION OF PETS

 

31.         A passenger is entitled to carry a pet in a container free of charge.

32.         A container with a pet shall allow passengers to pass by, it cannot be bulky, stain the seats of bus/trolleybus or passengers’ clothing.

33.         A passenger, having documents indicating that his/her pet has been vaccinated, shall be entitled to carry a pet on a bus/trolleybus without a container free of charge. A dog shall wear a muzzle, be kept on a leash that is no longer than 0.5 m and it shall not occupy a seat.

34.         If a pet stained a cabin of bus/trolleybus, a passenger, carrying it shall immediately clean up the stained place of a cabin.

35.         A passenger shall be responsible for damage caused to other passengers’ health, life, property, peace and shall compensate for it. A passenger shall also comply with Rules on pet and animal keeping in the territory of Vilnius City, approved by the Council of Vilnius City Municipality.

 

VII.     PASSENGER CONTROL

 

36.         A passenger control can be performed by control services of municipal institutions or their authorised offices, employees of a carrier or its authorised legal entity (hereinafter the controller), as well as state institutions to whom such right was granted by the law.

37.         A controller shall wear a distinctive sign (identity document or a pin) or a uniform and show controller’s licence at the request of the passenger.

38.         Controller shall check an electronic ticket using special inspection measures.

39.         At the request of controller, the passenger must provide a properly marked/activated ticket.

40.         If a passenger provides a marked/activated ticket with a discount, he/she shall also provide a valid document, entitling to use a ticket with a transport privilege.

41.         A passenger shall be considered riding without a ticket or carrying a child from seven to fourteen years old without a ticket, as well as a child from fourteen to sixteen years old shall be considered as riding without a ticket, if during the inspection of passenger control, he/she has not provided any ticket; provided a valid (activated) ticket with a discount; however, he/she has not provided a valid document, entitling to use a ticket with a transport privilege; provided an unmarked single ticket; a single ticket that has been marked two or more times; a single ticket that has been marked on another bus/trolleybus; has marked/activated ticket during the inspection; has an invalid (not activated) ticket.

42.         A passenger, who purchased a ticket with discount, but does not have the necessary documents, entitling to use a ticket with a transport privilege, riding on board without a ticket, carrying a child from seven to fourteen years old without a ticket, a child from fourteen to sixteen years old riding without a ticket or a passenger, who has not paid for the baggage or carry forbidden baggage, shall be subject to administrative liability pursuant to the procedure provided by the law. Controller shall have the right to set down the passengers from the bus/trolleybus.

43.         If controller determines a breach of these rules, he/she shall write a protocol of administrative offence to a passenger and, under appropriate conditions, he/she shall also write an administrative order or make a decision. A case of administrative offence shall be examined according to the procedure laid down in the Code of Administrative Offences of the Republic of Lithuania.

44.         If controller determines a breach of these rules, a passenger at the request of controller shall provide his/her identity document.

45.         Controller shall have the right:

45.1     To set down a passenger, who rode without a ticket, from the bus/trolleybus in order to write him/her a protocol of administrative offence;

45.2     To call the police and transfer offender to police officers, if a passenger, who rode without a ticket, fails to comply with legitimate orders of controller and/or tries to escape from the place where offence was committed;

45.3     To bring the passengers to the police station if they rode without tickets, had no or refused to provide their identity documents that were necessary to write a protocol of administrative offence;

45.4     To confiscate invalid or false tickets and documents;

45.5     To request that passengers perform his legitimate orders;

45.6     To enter a bus/trolleybus out of turn, regardless of the number of passengers on board.

46.         Allocation of administrative penalty shall not release a passenger from the obligation to pay for further ride and/or carriage of baggage.
